Cryptocurrency Long-Term vs. Short-Term Capital Gains

  • Cryptocurrency long-term capital gains (Cryptocurrency held over 1 year) are taxed at a maximum rate of 20%.

  • Cryptocurrency short-term capital gains (Cryptocurrency held under 1 year) are taxed as ordinary income, with a maximum rate of 37%.

Crypto capital gains are not subject to Social Security or Medicare taxes. Most states tax on your crypto capital gains, except: Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas, Washington, and Wyoming. Net Investment Income Tax Rate 2025

If your cryptocurrency gains or MAGI exceed these limits, you may also owe a 3.8% Net Investment Income Tax (NIIT). Key Features of the NIIT:

  • Applies to the smaller of two amounts:
    • Net investment income or
    • Modified Adjusted Gross Income (MAGI) above these limits:
      • $200,000 (Single Filers)
      • $250,000 (Married Filing Jointly)
      • $125,000 (Married Filing Separately)
      • $200,000 (Head of Household)

  • The NIIT applies on top of standard capital gains taxes and is calculated separately.

  • No distinction between short-term and long-term holdings—unlike capital gains tax rates, which vary based on holding periods, the NIIT applies to all investment income.
